INTRODUCTION

CASE LAWS are like bread and butter and no law students or a practicing advocate can stay away from it. For any or every law aspirants to professional, an interns in law company, practicing advocates in court of law, paralegal, corporate lawyers or a law company, main responsibility is studying and researching various case laws. These case laws are helpful in arguments for any case and stands as weight-age in arguments also influences the final verdict.

Research in conman parlance, refers to search of knowledge. Research can also be defined as systematic and scientific information on a relevant topic. Research capability is more of an art for thorough inspection and gathering relevant information from the valid legal source (CASE LAWS). Lawyers have an ethical obligation to their clients to be efficient legal researchers. Learning how to carefully research the case law while still in law school will save you a great deal of potential stress and professional setbacks. Professionally, an effective legal research will have a substantial impact on the outcome of your client's legal problem, as lawyers cannot make meritorious arguments for their clients without having legal authority to support their contentions.

OBJECTIVE OF THE COURSE 

Every case laws / judgments provided for the research work in all the courses starts with proof reading and formatting of judgments. Proof reading and formatting is a test of reading skill of the students. This workshop is more of an eligibility test and only if student clear the cut-off are eligible for the certificate First certificate course that deal with the CASE LAW

QUANTITATIVE ANALYSIS
. Since research work is the ability of the person to read and explore the sample data, this eligibility workshop also tests the skills of reading and understanding the raw data (Case Law) for research. an attempt of LAWHUB to enable all law pursuing students to understand in-depth various case laws and also to observe how specific legal rules are actually applied. The online platform provided to student to deeply research the case laws and generated the key points in the case law. 

CASE LAW RESEARCH WORKSHOP 
This is a custom designed case law research course mainly an eligibility test for other online case law research certificate courses listed on LawHub.in. This course is exclusively for law aspiring students in law colleges pursuing graduation or post graduation in Law. This workshop is based on a research on legal data mainly case laws and bare acts. workshop with hands on experiences for conducting a research on real time case laws delivered by Supreme Court Of India, various High courts in India and tribunal courts.

There are not many online programs that conducts the research work on case laws using the research methodology of quantitative and qualitative analysis of case laws. This is one reason that each student  has to undergo the Case Law Research Workshop as the eligibility test to opt other online case law courses.

This is an entry level workshop, each student opting for the research certificate or diploma course have to clear this workshop on case laws research. 200 case laws are allocated to each students these are case law randomly selected as courts judgments delivered that are delivered by various Indian State High courts and Supreme Court of India.

SYLLABUS:

  1. Online Workshop for 7 Days from the day of start of workshop. 
  2. Individual Login Id Will Be provided to all students valid for 7 Days during which the student have to perform the following research work
  3.  
    1. Student have to research each case law to generate the data point in the CASE LAW
    2. Proof read and format each case law and remove the junk data available in the case law
    3. Bare Acts categorization and sub categorization.
  4. 50 State Acts title will be provided to allocate the category and sub category.

1. PROOF READING: Any research project is based on raw data or based on some sample data. The sample data to be researched is case laws. Staying focused and patience is the key of any researched project. The proof reading of case laws is the patience test and also to stay focused on what you read. Proof reading involves a focused reading of the case laws and formats it with well defined formats and highlighting important research points. This proof reading is the first part of the case law research project can be stereotype or monotonous. Proper data validation and organising a sample data lays down a stepping stone for advancement of the research journey. It’s more like anything that starts in an organised way has all the chances to end with a motive that is met. Organising the research data for research is an important research criteria also setting up a path for successful and authentic research project.

"The sample case laws provided will have some junk data (intentionally provided) so that student reads the complete case laws  and remove the junk data that is not a part of the case law. Proper formatting with bullet text, paragraph and highlighting of the important point is the main object of the proof reading and data formatting"

Key for research on data is getting the data in a structured format. Proof reading and formatting does not the meet all the constraints of structuring an un structured data. But meets the constraints of validating the data and formatting is the first stage of structuring the data. After this the research data points should be normalised for effective research.

2. FIXED DATA POINTS (FDP): These are the fixed data points are available in each case laws. The fixed data points have to be submitted in the allocated field provided individual fixed data points. Weight age marks for each data point in the case law are as per Table 04 For marking the various fixed data point are grouped based on the time spent in and understanding the data points available is case laws. 200 Case laws are allocated to each student to generate the fixed data point for all the 200 case laws allocated to each student for research

Generating various FDP from the judgments text and storing in a pre defined attributes. These FDP are the research elements of the case law. By storing these FDP the unstructured case is generated into a structured format and each of the FDP is the area of research for the law student.

Following are the Fixed Data Points that have to be extracted from the case laws and stored in relevant field.

  1. Case Number: The number of the case as provided in the judgment
  2. Judgment Date 
  3. Judgment Type ( Selected from the predefined list )
  4. Jurisdiction of the Court: Original, appellate, Writs, Special Leave Jurisdiction, Advisory Jurisdiction, etc. according to the case.
  5. Judges Bench: ( Selected from the predefined list as per follows)
    • Name of One judge- Single Bench
    • Name of Two Judges- Division Bench
    • Name of Three or more Judges- Full Bench
    • Constitution Bench- Constitution Bench
  6. Citation: As provided in the case, this is about the judgments published in various law journals. 
  7. Judgment Category The category in which a judgment( Selected from the predefined list )
  8. Judgment Sub Category ( Selected from the predefined list ) 
  9. Disposition - As per the decision of the case ( To be selected from the predefined list available)

3. BARE ACT CATEGORISATION: List of 50 Bare acts title will be provided. Students have to read the complete bare act and allocated each bare acts to a relevant category and sub category. The list of pre defined category list is provided and the relevant category to be selected after exploring and understanding the bare acts text. Each main category is further categorised into sub categories. Students have to allocate the category and sub category for each bare act provided to the student.

WORKSHOP SUMMARY:

  • Analysis of Case Laws delivered from various Indian courts, Case Laws are provided to each student for the research.
  • A user-friendly web based interface is designed for each student to generate the various pre-defined legal data points of case laws.
  • Students have to generated data in the relevant field, extracted from the case law provided.

Missing Data Points in the judgments allocated

  • Search on web and generate the missing data points (if data not available in the case law test provided). URL of the website to be submitted in the data point remark section of the interface. Extra marks will be given for this that will have impact on the gradation of the certification For example, suppose citation, appeal number, etc. in allocated judgments is missing, the student have to dig out these data from judgments that can be found of various other website.

1. Failing to clear this test the student cannot opt for any other courses offered on LAWHUB.in.
2. Students can re appear for the eligibility without paying any extra fees for more attempts
3. Fresh 200 judgments will be allocated
4. Maximum of 4 Attempts can be made to clear the eligibility test and student can re appear only after 6 Months.
